32-1310. Confidentiality; limited release to public

A. All examination materials, records of examination grading and performance, and transcripts of educational institutions concerning applicants and licensees are confidential and are not public records.

B. Complaints, investigative reports, documents, exhibits and other materials relating to an investigation are not public records and shall remain confidential except as provided in subsections C and E of this section.

C. On written request, the department shall release confidential information to the subject of an informal interview and to the public after the department sends a case to an informal interview.

D. After receiving a complaint, the department shall inform the licensee of the name of the complainant and the general nature of the complaint.

E. During an investigation, after the department issues a formal hearing or informal interview notice and notifies the licensee, the department may release the name of the complainant and the general nature of the complaint to the public.
