AN ACT
MAKING APPROPRIATIONS, BUDGET REDUCTIONS AND TRANSFERS FOR FISCAL YEAR 2008-2009.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Arizona board of regents; support and
maintenance; supplemental appropriation reduction; transfer;
appropriation
A. In addition to the reductions made pursuant to Laws 2009, first special session,
chapter 1, section 3, the sum of $100,000,000 is reduced from the appropriation made from
the state general fund in fiscal year 2008-2009 to the Arizona board of regents for the
support and maintenance of institutions under its jurisdiction and is transferred to the
state general fund. The Arizona board of regents shall reduce funding to the institutions
under its jurisdiction in proportion to the state general fund appropriation received by
each institution.
B. In addition to any other amounts appropriated to the Arizona board of regents
for fiscal year 2009-2010, the sum of $100,000,000 is appropriated from the state general
fund in fiscal year 2009-2010 to the Arizona board of regents to be distributed for the
support and maintenance of institutions under its jurisdiction in two equal payments on
or before August 1, 2009 and September 1, 2009. The Arizona board of regents shall
distribute the monies appropriated in this subsection to the institutions under its
jurisdiction in an amount equal to the reduction made pursuant to subsection A of this
section.
Sec. 2. Department of education; school districts; state
aid apportionment; supplemental appropriation reduction; transfer;
fiscal year 2008-2009
Notwithstanding any other law, the sum of $300,000,000 is reduced from
appropriations made from the state general fund in fiscal year 2008-2009 to the
department of education and the superintendent of public instruction for basic state aid
and additional state aid to school districts and is transferred to the state general
fund. The appropriation reduction required by this section does not apply to charter
schools or to school districts that qualify for an exemption from the general budget
limit either for pupils in kindergarten programs and grades one through eight or for
pupils in grades nine through twelve, or both, pursuant to section 15-949, Arizona
Revised Statutes.
Sec. 3. Department of education; federal education
stabilization fund; supplemental appropriation reduction; transfer;
legislative intent; fiscal year 2008-2009
A. Notwithstanding any other law, if this state receives federal assistance from
the federal education stabilization fund, the sum of $250,000,000 is reduced from
appropriations made from the state general fund in fiscal year 2008-2009 to the
department of education and is transferred to the state general fund.
B. It is the intent of the legislature that in fiscal year 2008-2009, $250,000,000
will be disbursed from the federal education stabilization fund to the department of
education in order to restore the funding reduction made in subsection A. These monies
shall be disbursed in accordance with the provisions of the American recovery and
reinvestment act of 2009.
