AMENDING LAWS 2009, FIRST SPECIAL SESSION, CHAPTER 1, SECTIONS 4, 5 AND 7; REPEALING LAWS
2009, FIRST SPECIAL SESSION, CHAPTER 4, SECTION 10; MAKING APPROPRIATIONS, TRANSFERS AND
BUDGET REDUCTIONS FOR FISCAL YEARS 2008-2009.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Laws 2008, chapter 285, section 24 is amended to read:
Sec. 24. Transfer of fund monies to the state general
fund; fiscal year 2008-2009
A. On or before June 30, 2009, the following amounts from the funds or sources
indicated are transferred to the state general fund for the purposes of providing
adequate support and maintenance for agencies of this state:
1. State board of accountancy:
Board of accountancy fund - $1,016,700.
2. Acupuncture board of examiners:
Acupuncture board of examiners fund - $88,300.
3. Department of administration:

B. Agencies listed shall reduce expenditures from the listed funds accordingly in
order to ensure a sufficient fund balance for these fund transfers.
C. The fund transfers in this section shall be made as soon as is practicable to
avoid a shortfall in each fund. On or before September 1, 2008, the governor's office of
strategic planning and budgeting shall report to the joint legislative budget committee
on any fund transfers that have not been fully made as of August 15, 2008. For each fund
transfer not fully made as of September 1, 2008, the report shall list when the fund
transfer will be completed or additional steps required, in addition to those authorized
under subsection D, to make the full fund transfer.
D. Notwithstanding any other law, to provide for effective continuity of state
operations a budget unit may request a temporary cash transfer from one of its own funds
to another of its own funds from the state comptroller to accommodate a temporary cash
flow issue. The state comptroller shall coordinate all activity with the governor's
office of strategic planning and budgeting and shall notify the joint legislative budget
committee staff of any cash transfers pursuant to this section. This notice shall include
a monthly cash flow of all funds involved and shall include a plan for returning the
monies to their original fund. All monies temporarily used shall be returned to the
original fund no later than June 30, 2009. The state comptroller shall file a final
report on all activity under this provision with the joint legislative budget committee
staff and the governor's office of strategic planning and budgeting no later than
August 1, 2009.
Sec. 2. Laws 2008, chapter 288, section 13, as amended by Laws 2009, first special
session, chapter 4, section 7, is amended to read:
Sec. 13. AHCCCS; disproportionate share payments
Disproportionate share payments for fiscal year 2008-2009 made pursuant to section
36-2903.01, subsection P, Arizona Revised Statutes, include:
1. $89,877,700 for a qualifying nonstate operated public hospital. The Maricopa
county special health care district shall provide a certified public expense form for the
amount of qualifying disproportionate share hospital expenditures made on behalf of this
state to the administration on or before May 1, 2009 for all state plan years as required
by the Arizona health care cost containment system 1115 waiver standard terms and
conditions. The administration shall assist the district in determining the amount of
qualifying disproportionate share hospital expenditures. Once the administration files a
claim with the federal government and receives federal funds participation based on the
amount certified by the Maricopa county special health care district, the
administration shall deposit the monies in the state general fund. IF THE
CERTIFICATION IS EQUAL TO OR GREATER THAN $89,877,700, THE ADMINISTRATION SHALL
DISTRIBUTE $4,202,300 TO THE MARICOPA COUNTY SPECIAL HEALTH CARE DISTRICT AND DEPOSIT THE
BALANCE OF THE FEDERAL FUNDS PARTICIPATION IN THE STATE GENERAL FUND. IF THE
CERTIFICATION PROVIDED IS FOR AN AMOUNT LESS THAN $89,877,700, AND THE ADMINISTRATION
DETERMINES THAT THE REVISED AMOUNT IS CORRECT PURSUANT TO THE METHODOLOGY USED BY THE
ADMINISTRATION PURSUANT TO SECTION 36-2903.01, ARIZONA REVISED STATUTES, THE
ADMINISTRATION SHALL NOTIFY THE GOVERNOR, THE PRESIDENT OF THE SENATE AND THE SPEAKER OF
THE HOUSE OF REPRESENTATIVES, SHALL DISTRIBUTE $4,202,300 TO THE MARICOPA COUNTY SPECIAL
HEALTH CARE DISTRICT AND SHALL DEPOSIT THE BALANCE OF THE FEDERAL FUNDS PARTICIPATION IN
THE STATE GENERAL FUND. IF THE CERTIFICATION PROVIDED IS FOR AN AMOUNT LESS THAN
$89,877,700 AND THE ADMINISTRATION DETERMINES THAT THE REVISED AMOUNT IS NOT CORRECT
PURSUANT TO THE METHODOLOGY USED BY THE ADMINISTRATION PURSUANT TO SECTION 36-2903.01,
ARIZONA REVISED STATUTES, THE ADMINISTRATION SHALL NOTIFY THE GOVERNOR, THE PRESIDENT OF
THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES AND SHALL DEPOSIT THE TOTAL
AMOUNT OF THE FEDERAL FUNDS PARTICIPATION IN THE STATE GENERAL FUND.
2. $28,614,300 for the Arizona state hospital. The Arizona state hospital shall
provide a certified public expense form for the amount of qualifying disproportionate
share hospital expenditures made on behalf of the state to the administration on or
before March 31, 2009. The administration shall assist the Arizona state hospital in
determining the amount of qualifying disproportionate share hospital expenditures. Once
the administration files a claim with the federal government and receives federal funds
participation based on the amount certified by the Arizona state hospital, the
administration shall distribute the entire amount of federal financial participation to
the state general fund. If the certification provided is for an amount less than
$28,614,300, the administration shall notify the governor, the president of the senate
and the speaker of the house of representatives and shall distribute the entire amount of
federal financial participation to the state general fund. The certified public expense
form provided by the Arizona state hospital shall contain both the total amount of
qualifying disproportionate share hospital expenditures and the amount limited by section
1923(g) of the social security act.
3. $26,147,700 for private qualifying disproportionate share hospitals.

B. The fund transfers in this section shall be made as soon as is practicable to
avoid a shortfall in each fund. On or before March 15, 2009, the governor's office of
strategic planning and budgeting shall report to the joint legislative budget committee
on any fund transfers that have not been fully made as of February 28, 2009. For each
fund transfer not fully made as of March 1, 2009, the report shall list when the fund
transfer will be completed or additional steps required to make the full fund transfer.
Sec. 5. Laws 2009, first special session, chapter 1, section 7 is amended to read:
Sec. 7. Personnel appropriations; fiscal year 2008-2009;
revertment
Notwithstanding any other law, $10,854,200 $9,369,900 is reduced from
other state funds that were appropriated to state agency units in fiscal year 2008-2009
and from nonfederal nonappropriated funds for personnel expenses and related benefit
costs and is transferred to the state general fund for the purposes of providing adequate
support and maintenance for agencies of this state. The joint legislative budget
committee staff shall determine and the department of administration shall allocate to
each agency or department the amount of reduction for each agency's fund.
Sec. 6. Repeal
Laws 2009, first special session, chapter 4, section 10 is repealed.
Sec. 7. Supplemental appropriations; Arizona health care
cost containment system
A. In addition to the appropriation made by Laws 2008, chapter 285, section 3, the
sum of $5,559,200 is appropriated from the state general fund and $20,443,800 in
additional expenditure authority of federal monies is appropriated in fiscal year
2008-2009 to the Arizona health care cost containment system to restore funding for
graduate medical education services.
B. In addition to the appropriation made by Laws 2008, chapter 285, section 3, the
sum of $2,500,800 is appropriated from the state general fund and $9,657,300 in
additional expenditure authority of federal monies is appropriated in fiscal year
2008-2009 to the Arizona health care cost containment system to restore funding for rural
hospital reimbursement.
Sec. 8. Supplemental appropriation; department of
economic security; child care; condition
A. In addition to the appropriation made by Laws 2008, chapter 285, section 6, the
sum of $18,200,000 is appropriated from the federal child care and development fund block
grant in fiscal year 2008-2009 to the department of economic security to maintain
existing child care services. These monies may not be used to expand eligibility or
increase provider payments for child care services beyond the levels in effect as of
January 30, 2009.
B. The appropriation made in subsection A of this section is not effective unless
this state receives at least $18,200,000 in federal child care and development fund block
grant monies from the American recovery and reinvestment act of 2009.
Sec. 9. Appropriations; purpose
A. The sum of $4,659,666 is appropriated from the state general fund to the
Arizona property and casualty insurance guaranty fund established by section 20-662,
Arizona Revised Statutes, in each of fiscal years 2011-2012, 2012-2013 and 2013-2014.
B. The sum of $5,204,466 is appropriated from the state general fund to the life
and disability insurance guaranty fund established by section 20-683, Arizona Revised
Statutes, in each of fiscal years 2011-2012, 2012-2013 and 2013-2014.
C. It is the intent of the legislature to acknowledge that the exclusive purpose of
the two guaranty funds is to pay claims of policy holders and claimants of insolvent
insurers.
