NCLB opt out; cost study

HB 2392 requires a study to be
conducted on the potential costs of opting out of the No Child Left Behind Act
(NCLB) and requires Arizona to opt out of NCLB beginning January 1, 2009.
History
NCLB was signed by President Bush
on January 8, 2002, and took effect at the beginning of the 2002-03 school
year. The four principles of NCLB are 1) provide stronger accountability for
both schools and states, 2) expand options and choice for parents, 3) place
emphasis on research-based methods for teaching reading instruction, and 4) expand
flexibility and local control.
Some components of NCLB include:
·
By 2005, every state must test all students annually in reading
and math in grades 3 through 8. Additionally, by 2007, students must be tested
in science.
·
States must demonstrate "adequate yearly progress"
(AYP) toward state learning standards disaggregated for all groups of students,
with the goal of 100% proficiency for all students by the 2013-14 school year.
·
There must be “highly qualified” teachers to teach core academic
subjects in every classroom by the fall of 2005.
·
Primary grade teachers must deliver reading instruction in K-3
based on "scientifically based" reading research.
·
States must have an "Unsafe School Choice Option,” a plan
that allows students to transfer to a safe school if they attend a school
designated as persistently dangerous school or become a victim of violent
crime.
Provisions
·
Requires the Arizona Department of Education (ADE) to work with
the State Board of Education and the School Facilities Board to conduct a study
on the potential costs of Arizona opting out of NCLB.
·
Stipulates that the study include the following information:
·
The potential loss of federal monies.
·
The potential sanctions against school districts and charter
schools.
·
The extent to which Arizona and its school districts and charter
schools would be required to follow NCLB after opting out.
·
The current impact on school districts and charter schools that
are not currently accepting federal monies.
·
The current amount spent by Arizona to comply with the
requirements of NCLB.
·
The amount of recurring or projected expenditures necessary for
Arizona to continue complying with NCLB.
·
The amount of state funding needed to offset the potential loss
of federal monies if Arizona opts out of NCLB.
·
Requires ADE to complete the study and submit a final report to
the Governor and Legislature by December 15, 2008.
·
Mandates Arizona to opt out of participating in NCLB beginning
January 1, 2009.
·
Beginning in FY 2009-10, specifies that ADE must request a
separate line item appropriation in their budget estimate to offset the loss of
federal monies as a result of opting out of NCLB.
·
Contains a delayed repeal from and after September 30, 2009.
Amendments
Education (K-12)
·
Changes the date when the ADE must submit their cost study report
to the Legislature from December 15, 2008 to June 30, 2009.
·
Changes the date when the state must opt out of NCLB from January
1, 2009 to July 1, 2010.
·
Changes the time when the ADE must request a separate line item
appropriation to offset the loss of NCLB monies from FY 2009-10 to FY 2010-11.
·
Makes conforming changes.
