AN ACT
amending title
16, chapter 1, article 2, Arizona Revised Statutes, by adding section
19-111.01; relating to initiative and referendum; providing for conditional
enactment.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 19, chapter 1, article 2, Arizona Revised Statutes, is amended by adding section 19-111.01, to read:
START_STATUTE19-111.01. Text review; legislative council;
hearing; recommendations; title
A. a person
or organization that has filed an application with the secretary of state
pursuant to section 19-111 intending to propose a law or constitutional
amendment by initiative petition shall submit a copy of the text of the
proposed law or CONSTITUTIONAL amendment to the legislative council at any time
after the application for the measure is filed and before petition signatures
are filed in the office of the secretary of state as prescribed by section
19-121.
B. On
receipt of the text of the measure, the legislative council shall hold a public
hearing on the measure to take testimony and consider other information on the
proposed measure, including the effect of the measure on existing law, errors
in the drafting of the measure, confusing, conflicting or inconsistent
provisions within the measure and conflicts with other state and federal laws.
C. On
completion of the hearing, the legislative council shall consider and may
prepare recommendations to improve the text of the proposed measure and shall
establish the official title for the measure.
D. The
person or organization PROPOSING the law or constitutional amendment may
accept, modify or reject any recommendations made by the legislative council,
and may file an application to circulate a new measure with new text, solely in
its discretion.END_STATUTE
Sec. 2. Conditional enactment
This act does not become effective unless the Constitution of Arizona is amended by a vote of the people at the next general election to require review
of proposed initiatives by legislative council.
