HOUSE OF REPRESENTATIVES AMENDMENTS TO S.B. 1441

Strike everything after the enacting clause and insert:

"Section 1.  Title 17, chapter 4, Arizona Revised Statutes, is amended by adding article 4, to read:

ARTICLE 4.  WILDLIFE HABITAT RESTORATION AND ENHANCEMENT FUND

START_STATUTE17-471.  Wildlife habitat restoration and enhancement fund; commission duties

A.  The wildlife habitat restoration and enhancement fund is established consisting of legislative appropriations for specific wildlife habitat restoration and enhancement projects.  Monies in the fund are subject to legislative appropriation and are exempt from the provisions of section 35-190 relating to lapsing of appropriations.  On notice from the director of the Arizona game and fish department, the state treasurer shall invest and divest monies in the fund as provided in section 35-313 and monies earned from investment shall be credited to the fund.

B.  The commission shall:

1.  Monitor and have oversight of specific projects for which the legislature appropriates monies to the wildlife habitat restoration and enhancement fund.

2.  If necessary, change the priority of appropriated projects under its oversight, but any change in priority shall be subject to approval of the commission at a public hearing.

3.  Submit a semiannual report on the work, goals, objectives and funding of the wildlife habitat restoration and enhancement fund to the governor, the president of the senate, the speaker of the house of representatives, the chairpersons of the Senate and House of Representatives appropriations committees and provide a copy of the report to the secretary of state and the director of the Arizona state library, archives and public records.

Sec. 2.  Appropriation; wildlife habitat; exemption

A.  The sum of $5,000,000 is appropriated from the state general fund in fiscal year 2006-2007 to the wildlife habitat restoration and enhancement fund and is appropriated from the fund to the Arizona game and fish department only for the following purposes in the order of priority given, unless changed at a public hearing by the commission:

1.  Anderson Mesa grassland restoration.

2.  Kaibab winter range habitat improvement.

3.  Wildlife water redevelopment in Yuma.

4.  Private land grassland restoration in southern Arizona.

5.  Private land grassland restoration in northern Arizona.

6.  4A 4B summer winter range habitat improvement project.

7.  Statewide private land access projects.

8.  Arizona strip wildlife water redevelopments.

9.  Mogollon Rim trout stream restoration projects.

10.  Wildlife water redevelopments statewide.

11.  Chitty Creek habitat restoration project.

12.  Pigeon habitat restoration project.

13.  Sheep Wash ecosystem improvement project.

14.  NO Bar habitat restoration project.

15.  Sunset Peak habitat restoration project.

16.  GMU 3B grassland restoration/juniper removal.

17.  Black River burn restoration.

B.  The appropriations made in subsection A of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations."
